Legal luminaries numbering hundreds have sent a warning to
the British Prime Minister David Camron that the outcome of last month’s EU
referendum is not legally binding.
Stressing that the referendum is only “advisory” thus, the
government should unveil an autonomous investigation in order to analyse the
benefits, risks and costs of the referendum before making plans.
The letter was signed by over 1,000 barristers and sent to
Mr. Cameron stressing the need for a primary legislation before Article 50 of
the Lisbon Treaty which spells out the exit process is put to use
They claimed that there is evidence that the outcome of the
referendum “was influenced by misrepresentations of fact and promises that
could not be delivered”.
Furthermore, they stressed that “Since the result was only
narrowly in favour of Brexit, it cannot be discounted that the
misrepresentations and promises were a decisive or contributory factor in the
result”.
Questions also emerged with respect to the negotiating position
of the UK after Article 50 is triggered, asking what happens if an agreement is
not reached with two year limit as provided, or the “emerging reality” that the
Article’s negotiation only deals with how the UK leaves the Union, rather than
any future economic relationships.
These questions have made the barristers to call for an
investigation to take place with urgency and make the report available before
the Parliamentary vote takes place.
